These Terms of Use govern the use of the service offered on this website for the creation of AI-generated coloring pages, the transformation of uploaded images into coloring pages, and the online coloring tool (collectively, the “Service”). By using the Service, you accept these Terms as binding.
1. Subject Matter of the Service
(1) The operator provides an online service through which users can automatically generate coloring pages and coloring images based on text inputs (“prompts”) and can also transform uploaded images into coloring pages.
(2) The content is generated or processed automatically by an external AI model. The results are created automatically and may be inaccurate, incomplete, or unexpected.
(3) The Service is primarily intended for families and children.
(4) In addition, the operator provides a browser-based online coloring tool (“Coloring Tool”) that allows users to digitally color, edit, save, and download AI-generated coloring pages, coloring pages transformed from uploaded images, or other coloring pages made available through the Service.
2. Registration, Email Verification & User Account
(1) A valid email address is required to download generated or transformed images and to access the personal user area.
(2) Registration is carried out via a one-time confirmation link (“magic link”).
(3) The user undertakes not to provide any third-party or unlawfully used email addresses and, in particular, not to use disposable or temporary email addresses where this may impair the purpose or security of the Service.
(4) The operator may suspend or delete user accounts if there are indications of misuse, false information, or violations of these Terms of Use.
(5) By registering for our Service, you provide your email address in order to use the offered functions. Within the scope of this existing customer relationship, we may inform you by email about similar own offers, feature updates, or improvements to our AI coloring page generator, to the extent permitted by applicable law. You may object to this use of your email address at any time. A corresponding unsubscribe link is included in every email.
3. Rules of Conduct and Prohibited Uses
(1) The Service may only be used for lawful, child-appropriate, and non-harmful purposes.
(2) Users are prohibited in particular from entering prompts, uploading images, or creating content that requests, depicts, or promotes any of the following:
Violence, brutality, weapons, war scenes, or combat scenes
Sexual content, nudity, erotic content, or sexual acts
Depictions of minors in inappropriate or dangerous situations
Discriminatory, antisemitic, racist, extremist, or politically radical content
Illegal activities, abuse, drugs, or self-harm
Defamatory content or content violating personal rights of real persons
Content intended specifically to imitate copyrighted works, trademarks, or well-known characters
(3) The user is also prohibited from uploading images:
a) for which the user does not hold the necessary rights or is not otherwise sufficiently authorized to use;
b) that contain personal data of third parties in an unlawful manner or without sufficient authorization;
c) that contain unlawful, abusive, harmful to minors, or otherwise impermissible content;
d) that are intended to circumvent technical protection measures or may impair the security, stability, or integrity of the Service.
(4) The operator reserves the right to review requests and uploaded content automatically or manually and to reject them in impermissible cases.
(5) In the event of repeated or serious violations, the operator may immediately suspend or permanently block access.
4. Use of AI-Generated and Transformed Images
(1) Depending on the individual presentation, the operator grants the user a simple, non-exclusive, non-transferable right to use the images generated by the user or transformed from images uploaded by the user.
(2) Commercial use of the generated or transformed images is only permitted if this is expressly allowed on the website or in separate notices.
(3) The operator does not guarantee that AI-generated or automatically transformed content is free of third-party rights. The training data of the AI model and the automated processing are not fully controllable by the operator; therefore, it cannot be excluded that images may resemble protected works or that results may be generated that do not legally or factually meet the user’s expectations.
(4) Users bear sole responsibility for their use of the generated or transformed images.
(5) To the extent that the user uploads images, the user represents that they hold the necessary rights of use and that the upload, processing, transformation, storage, and use within the Service do not infringe any third-party rights.
4a. Use of the Online Coloring Tool
(1) The Online Coloring Tool allows users to digitally color coloring pages directly in the browser, select colors, fill areas, and make simple edits.
(2) Use of the Coloring Tool is permitted exclusively for private, non-commercial purposes unless expressly agreed otherwise or stated on the website.
(3) Images created or edited in the Coloring Tool constitute edits of the underlying coloring pages. The rights of use under Section 4 of these Terms apply accordingly.
(4) The Coloring Tool may be used with both AI-generated images and coloring pages transformed from uploaded images.
(5) The operator does not guarantee that images stored or edited in the Coloring Tool will remain permanently available. Users are responsible for saving or downloading their results in due time.
(6) The Coloring Tool does not constitute professional graphics or design software. There is no entitlement to specific functions, tools, or loss-free display on all devices.
(7) The operator reserves the right to change, restrict, or discontinue functions of the Coloring Tool at any time, in particular for technical, security-related, or economic reasons.
5. Rights to Storage and Processing
(1) The user agrees that their entered prompts, uploaded images, generated or transformed images, and usage data may be technically processed and temporarily stored or stored within the user account in order to provide the Service, enable account and history functions, improve the Service, and prevent misuse.
(2) Disclosure to third parties takes place only to the extent necessary for the technical provision of the Service (e.g. hosting, email delivery, AI model, or image processing).
(3) Uploaded images may be transmitted to external technical service providers to the extent necessary for the transformation into coloring pages or for the provision of the Service.
(4) Further information is set out in the separate Privacy Policy.
(5) When using the Online Coloring Tool, editing states, color information, or interim results may be stored temporarily to the extent necessary for the technical provision or user convenience of the tool.
6. Responsibility of the User
(1) The user is responsible for all content that they request, create, upload, or edit through the Service.
(2) Parents and legal guardians are responsible for use by minor children and must appropriately supervise such use.
(3) The user undertakes not to circumvent or manipulate technical, security-related, or youth-protection-related protective measures.
(4) The Online Coloring Tool may not be used to create or distribute impermissible, harmful to minors, or unlawful content.
(5) The user is responsible for checking, before uploading images, whether they are entitled to do so and whether the processing of the depicted content is legally permissible.
7. Technical Availability
(1) The operator endeavors to ensure trouble-free operation of the Service but does not guarantee availability, functionality, or freedom from errors.
(2) Maintenance work, external outages (e.g. AI models, image processing services, or infrastructure), network problems, or force majeure may temporarily impair use.
8. Abuse Prevention, Rate Limits & Suspensions
(1) The operator is entitled to implement technical protective measures, including in particular:
IP rate limits
Blocking of suspicious use
Spam and bot detection
Restrictions on the number of generated, transformed, or edited images
(2) The operator may temporarily suspend or permanently terminate access if misuse or a threat to the Service exists.
9. Disclaimer of Liability
(1) The operator shall only be liable for damages arising from the use or non-use of the Service in cases of intent or gross negligence.
(2) Liability for indirect damages, lost profits, or consequential damages is excluded.
(3) AI-generated, automatically transformed, and digitally edited content may be inaccurate, unsuitable, or faulty. The operator assumes no responsibility for this.
(4) The operator assumes no liability that images uploaded by the user can be processed, stored, or reproduced if technical, legal, or content-related reasons prevent such processing.
10. Term and Deletion
(1) The user may request deletion of their account at any time. Associated content, in particular stored prompts, uploaded images, generated or transformed images, and edits, will be deleted unless statutory retention obligations apply.
(2) The operator may delete inactive user accounts after a reasonable period of time.
(3) There is no entitlement to restoration of deleted images, edits, or accounts.
11. Amendments to the Terms of Use
(1) The operator reserves the right to amend these Terms of Use at any time.
(2) Users will be informed of material changes in an appropriate manner.
(3) Continued use after the amendments take effect shall constitute acceptance of the new Terms.
12. Final Provisions
(1) The law of the Federal Republic of Germany shall apply unless mandatory statutory provisions provide otherwise.
(2) Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) To the extent legally permissible, the place of jurisdiction shall be the registered seat of the operator.
